Please read these rules before entering the sweepstakes (the “Sweepstakes”). Participation in the Sweepstakes constitutes your (“you” or “Entrant”) full and unconditional agreement to and acceptance of these Official Rules and Regulations (“Official Rules”) and represents that you satisfy all of the eligibility requirements set forth below.
1. Sponsor. The sponsor of the Sweepstakes (“Sponsor”) is Rockstar Games, a wholly owned subsidiary of the United States company Take-Two Interactive Software, Inc. The Sponsor’s address is Rockstar Games, 622 Broadway, New York, NY 10012, USA.
2. Eligibility and Entry. The Sweepstakes is open only to individuals who (i) are registered members of www.twitter.com, and have their account set to “public” for the duration of the Sweepstakes Period (defined below) plus seven (7) days thereafter (for notification purposes), (ii) are legal residents of Austria, Belgium, Canada (excluding Quebec), Finland, Germany, Netherlands, New Zealand, Norway, Puerto Rico, South Korea, Switzerland, Ukraine, the United Kingdom, or the United States, (iii) are either (a) 17 years of age on date of entry if a resident of the United States or (b) 18 years of age on the date of entry for all other countries, and (iv) Retweet in full the contest entry message by @RockstarGames, specifically: “We're giving away 10 Red Dead Redemption 2: Collector's Boxes to celebrate the special limited-time re-release at the Rockstar Warehouse. Follow @RockstarGames and retweet this today by 11:59pm ET for a chance to win. Eligibility/Rules: https://rsg.ms” (“Retweet & Follow”). United States entrants who are minors must have permission from their parents or legal guardians in order to participate.
Directors, officers and employees of Sponsor, its parent, and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to participate or win any prizes. All applicable federal, state and local laws and regulations apply.
If you or anyone in your household (mailing address) has won a prize pack sweepstakes in the previous 180 days (from the first day of the Sweepstakes Period), you are not eligible to enter these Sweepstakes.
Limit one entry per person and Twitter account during the Sweepstakes Period. You may not enter multiple times using multiple Twitter accounts. Robotic, programmed, script, macro or other automated Retweet entries (collectively “automated entries”) are not permitted. Verified or suspected cheating or attempts to cheat by a contestant (including, without limitation, by entering multiple times, submitting automated entries, or using a false identity to enter the Sweepstakes) may result in you being excluded from the Sweepstakes. Sponsor is not responsible for late, lost, delayed, incomplete, corrupt, or misdirected entries, responses, paper entries or other correspondence, whether by internet transmission, email or postal mail or otherwise, or for theft or destruction or unauthorized access or alterations of entry materials, phone, electrical, network, computer, hardware, software program or transmission malfunctions, or any other failures or difficulties whether mechanical, human, or electronic. Only fully completed Retweets are eligible. Automated entries, or multiple entries by the same person or same Twitter account, will be disqualified.SWEEPSTAKES VOID WHERE PROHIBITED.
Retweets must comply with Twitter’s terms of use. By entering these Sweepstakes, you agree that your Retweet conforms to the following content restrictions (“Content Restrictions”) and that Sponsor, in its sole discretion, may remove any Retweet and disqualify you from the Sweepstake if Sponsor believes that your Retweet fails to conform to any of the following: (i) the Retweet must not contain material that violates or infringes another’s rights including, but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights; (ii) the Retweet must not disparage Sponsor(or any of its affiliates) or any other person or entity; (iii) the Retweet must not contain brand names or trademarks of any third-party entity; and (iv) the Retweet must not contain any material that is racist, offensive, pornographic, vulgar, profane, defamatory, insulting, unlawful, inappropriate, or otherwise objectionable.
3. Sweepstakes Period. The Sweepstakes Period starts at 12:00:01 AM ET on July 13th, 2021 and ends at 11:59:59 PM ET on July 13th, 2021 (“Sweepstakes Period”). Retweets received after the Sweepstakes Period will be deemed void and ineligible to be selected as a potential winner. Ten (10) winners will be randomly selected from among all eligible entries received during the Sweepstakes Period. Eastern Time or “ET” is the local time zone for New York City in the United States.
4. Winning. 10 prizes will be awarded. 10 potential winners will be determined by random drawing on the next business day after the end of the Sweepstakes Period. The drawing will be conducted by Sponsor. Sponsor’s decisions are final and binding. The potential winners will be notified via direct message on Twitter after the drawing. If any prize notification message is returned or undeliverable, or potential winner does not respond within 36 hours of notification, or refuses to execute the applicable documents, the prize will be forfeited and awarded to an alternate winner. The potential winners will be declared winners if it is determined that they are eligible after they have returned all required documentation to the email address provided in the direct message. If a Belgian or Canadian resident is selected as the potential winner, he/she will also be required to correctly answer a time-limited mathematical question in order to win his/her prize.
5. Prizes and Odds. There are 10 prizes (each a “Prize”) comprised of one (1) Red Dead Redemption 2: Collector’s Box consisting of promotional physical replicas of certain in-game items which may include a pin set, themed playing cards, a collectible challenge coin, double-sided puzzle, and/or other promotional collectable items related to Red Dead Redemption 2. Approximate Retail Value (“ARV”) of each Prize is $99.99/€82.30 (all values exclude Value Added Tax (“VAT”)). Total value of all Prizes is US $999.90/€823.01 (excluding Value Added Tax (“VAT”)). Odds of winning are determined upon the number of entries. Prizes are not transferable. No substitutions or exchanges (including for cash) of any Prizes will be permitted, except that Sponsor reserves the right to substitute a Prize of equal or greater value for any prize. If any Prize or notification message is returned or undeliverable, or potential winner does not respond within 36 hours of notification, or refuses to execute the applicable documents, the Prize will be forfeited and awarded to an alternate winner. Winner may be required to complete and submit documents including an affidavit of eligibility, publicity release, and/or appropriate tax forms to receive a prize. If an eligible potential winner is considered a minor in his/her jurisdiction of residence, his/her parent or legal guardian will have to execute the appropriate documents and such prize will be delivered to minor’s parent/legal guardian and awarded in the name of parent/legal guardian. Sponsor will not replace any lost or stolen prize.
TO THE EXTENT ALLOWABLE BY LAW, FEDERAL, STATE, AND LOCAL TAXES, INCLUDING, WITHOUT LIMITATION, AS APPLICABLE, VAT TAXES AND CUSTOMS WHICH ARE ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
In case of dispute, entries will be declared made by the authorized account holder of the Twitter account used to submit the entry. "Authorized account holder" of a Twitter account is defined as the person assigned to the Twitter account by Twitter. Multiple Entrants are not permitted to share the same Twitter account.
6. Collection of Information. Entrant’s personal data submitted to, or collected by, Sponsor in connection with the Sweepstakes will be processed by Sponsor and/or data processors appointed by Sponsor for the purposes of conducting, administering and marketing the Sweepstakes. Each Entrant understands that Sponsor has a valid legitimate interest in processing such personal data for these purposes and that Sponsor’s legitimate interests are not outweighed by Entrant’s own interests or fundamental rights and freedoms. Any personal data submitted to, or collected by, Sponsor or its data processors in connection with the Sweepstakes will be processed in accordance with Sponsor’s Privacy Policy. By participating in the Sweepstakes, contestants hereby acknowledge that they have read and understood Sponsor’s Privacy Policy
7. Intellectual Property Rights; Name and Likeness.
By submitting a Retweet to the Sweepstakes, you represent and warrant that you own all right, title and interest in and to your Retweet and that your Retweet complies with all of the Content Restrictions.
All Retweets will become the exclusive property of Sponsor, and none will be acknowledged or returned. Sponsor shall have the right to copy, edit, adapt and publish or not publish any or all of the Retweets, and may use them in any media without attribution or compensation to the contestant, their successors or assigns, or any other entity. CREATING AND SUBMITTING A RETWEET IN THESE SWEEPSTAKES CONSTITUTES THE ENTRANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANSFERENCE TO SPONSOR OF ANY AND ALL RIGHT, TITLE AND INTEREST IN THE RETWEET OR ANY DERIVATIVE WORKS CREATED USING THE RETWEET INCLUDING, WITHOUT LIMITATION, ALL INTELLECTUAL PROPERTY RIGHTS, INCLUDING COPYRIGHTS.
BY ENTERING THE SWEEPSTAKES, EACH ENTRANT HEREBY UNCONDITIONALLY AND IRREVOCABLY: (I) WAIVES ANY AND ALL MORAL RIGHTS (IF ANY) WHICH THEY MAY HAVE IN ANY RETWEET IN ACCORDANCE WITH COPYRIGHT ACT OF 1976 OR ANY SIMILAR LEGISLATION THROUGHOUT THE WORLD, PROVIDED THAT, IF UNDER ANY APPLICABLE LAW THE FOREGOING WAIVER IS NOT EFFECTIVE, EACH ENTRANT UNDERTAKES THAT IT SHALL EXERCISE SUCH RIGHTS REASONABLY AND IN A WAY THAT WILL NOT HAVE A MATERIAL ADVERSE EFFECT UPON SPONSOR, THEIR RESPECTIVE PRODUCTS OR SERVICES AND/OR THE EXERCISE BY SPONSOR OF ANY OF THEIR RIGHTS HEREUNDER; AND (II) GRANTS TO SPONSOR ALL CONSENTS REQUIRED PURSUANT TO THE COPYRIGHT ACT OF 1976 OR PURSUANT TO ANY OTHER LEGISLATION IN ANY JURISDICTION, TO ENABLE THE EXPLOITATION REFERRED TO IN THESE OFFICIAL RULES.
Except where prohibited by law, as a condition of receiving any Prize, you consent to the use of your, name, photo and/or likeness, biographical information, winning Retweet and statements attributed to you (if true) for advertising and promotional purposes without additional compensation.
8. Limitation of Liability. To the extent permitted by applicable law, by entering the Sweepstakes, you release Sponsor and Twitter, and their respective parent companies, subsidiaries, affiliates, partners, owners, governors, representatives, agents, successors, assigns, employees, officers, directors, distributors, retailers and advertising/promotional agencies (collectively, the “Released Parties”) from any liability whatsoever, and agree not to make any claims against the Released Parties in respect of any costs, injuries, losses, or damages of any kind (whether compensatory, direct, incidental, consequential or otherwise) arising out of or in connection with the Sweepstakes (including, without limitation, participation in the Sweepstakes or any printing or typographical errors in any materials associated with the Sweepstakes) or delivery, misdelivery, acceptance, possession, use of or inability to use any Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, and any copyright infringement, trademark infringement, or other intellectual property-related cause of action), whether under a theory of contract, tort (including negligence), warranty or other theory. Some jurisdictions do not allow (i) the exclusion of implied warranties on applicable statutory rights; and in the case of the countries of Germany, the United Kingdom, and/or the Netherlands, (ii) limitations on a contracting party’s liability with regards to damages or death caused due to its negligence or intentional misconduct, so the above exclusions and limitations may not apply in some cases. Under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (e.g., costs associated with entering these Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased even if otherwise permitted under applicable law.
Sponsor reserves the right to cancel or postpone the Sweepstakes without liability upon, and Sponsor will not be liable for any failure to comply with its obligations or any delay in performing its obligations under these Official Rules due to, (i) technical or other difficulties the occurrence of is beyond Sponsor’s control; or (ii) the compromising of the integrity of the Sweepstakes including, without limitation, due to fraud.
THE SWEEPSTAKES AND PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
9. Affidavit/Declaration and Release. As a condition of being awarded any prize, winners may be required to execute and deliver to the Sponsor a signed affidavit or declaration of eligibility and acceptance of these Official Rules and release of liability, as permitted by applicable law. Failure to return a signed affidavit or declaration within two (2) days may result in forfeiture of prize. Potential winners are responsible for ensuring return of all required materials; proof of sending will not be considered proof of receipt by the Sponsor. Potential winners will be required to sign a publicity release where applicable.
10. Winners List; Rules Request. A list of winners will be posted at www.rockstargames.com/socialclub/events no earlier than August 13th, 2021 and until September 13th, 2021. 11. Entrants Bound by Rules; Sponsor’s Decisions Final. By entering the Sweepstakes, you accept and agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor’s decisions in all respects relative to the Sweepstakes are final. Sponsor reserves the right to disqualify any winner, as determined by Sponsor in its sole discretion.
12. Disputes. Except where prohibited by law: (a) As a condition of participating in this Sweepstakes, Entrant agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective; (b) Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (e.g., costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased; and (c) The arbitration shall be conducted in the State of New York, in the City of New York, County of New York, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
13. Governing Law and Jurisdiction. Except where prohibited by law, this promotion is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Disputes Section of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of New York, in the City of New York, County of New York.
14. Miscellaneous. In the event of any conflict between the English version of these Official Rules and any translation, the English version shall prevail. The invalidity or unenforceability of any provision herein shall not affect in any way the validity and enforceability of any other provision in these Official Rules. Your participation in the Sweepstakes is also subject to the Terms of Use available at http://www.rockstargames.com/legal.
